2. Scope of application, definitions

- These General Terms and Conditions (GTC) shall apply to all our deliveries to consumers (§ 1 KSchG).
- Consumers are consumers within the meaning of the Consumer Protection Act (KSchG) and thus natural or legal persons who are not entrepreneurs. An entrepreneur is someone for whom the transaction is part of the operation of his business. An enterprise is any permanent organisation of independent economic activity, even if it is not profit-oriented. Legal persons under public law shall always be deemed to be entrepreneurs.
- The conclusion of contracts is only possible for persons who have reached the age of 18.

3. Conclusion of contract

- The presentation of the products in the online shop does not constitute a legally binding offer, but an invitation to order.
- By clicking the "Place order" button at the end of the ordering process, you make a binding contractual declaration to purchase the items in the shopping basket.
- The purchase contract is concluded when we accept your order by sending an order confirmation by e-mail immediately after receiving your order.

4. Prices and shipping costs

- All prices stated in the online shop are total prices. The total prices include all price components including the applicable statutory value added tax. Additional customs duties and fees apply for deliveries to non-EU countries. Further information can be found, for example, at  http://ec.europa.eu/taxation_customs/customs/customs_duties/index_de.htm and on import turnover tax at http://auskunft.ezt-online.de/ezto/Welcome.do and specifically for Switzerland at http://xtares.admin.ch/tares/login/loginFormFiller.do.
- We charge the costs for packaging and shipping (shipping cost share) separately. For details of the shipping costs and thresholds for a delivery free of shipping costs, please refer to our shipping costs table .

5. Terms of payment

We offer the following payment options through our payment provider Payone:

- Payment by Credit Card (AMEX, Master, VISA)
- Payment by DirectEbanking (EPS)
- Payment by GooglePay
- Payment by ApplePay

6. Delivery are and period

- The delivery of the goods is carried out by shipping with our carefully selected shipping service providers to the delivery address provided by you.
- For delivery times for deliveries within and outside the EU member states, please refer to our shipping costs table or the delivery time information on the respective item detail page.
- When paying in advance, you issue a payment order to your payment service provider. The delivery period begins to run on the day following the payment order to your payment service provider. If the end of the period falls on a Saturday, Sunday or a state-recognized public holiday at the place of delivery, the next business day shall be decisive for the end of the period.

7. Retention of property

The goods remain our property until full payment has been made.

8. Statutory right of withdrawal

The statutory right of withdrawal applies exclusively to consumers within the EU Member States. For the definition of a consumer, section 2.2 of these GTC applies.

9. Legal liability for defects

You are entitled to the statutory claims for defects for products purchased from us.

10. Applicable law, place of jurisdiction

-  The law of the Republic of Austria shall apply to the conclusion and execution of all contracts to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG). In the case of consumers, this choice of law shall only apply insofar as the protection granted is not restricted by mandatory provisions of the law of the state in which the consumer has his habitual residence.
- In business transactions with merchants and legal entities under public law, our registered office shall be the exclusive place of jurisdiction for all disputes arising directly or indirectly from the contractual relationship. The same shall apply if an entrepreneur does not maintain a general place of jurisdiction in Austria or if his place of residence and/or habitual abode is unknown at the time the action is brought. Our right to invoke the court at another statutory place of jurisdiction remains unaffected by this.
